GREAT GHOST SEARCH CONTEST OFFICIAL RULES

1.GREAT GHOST SEARCH CONTEST: NO PURCHASE NECESSARY TO PARTICIPATE OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHEREVER PROHIBITED OR RESTRICTED BY LAW. Great Ghost Search Contest (the “Contest”) is open to legal residents of the 50 United States, and the District of Columbia, subject to eligibility guidelines below. The Contest begins at 12:00 AM Pacific Time [“PT”] on September 24, 2024 and ends at 11:59 PM PT on November 1, 2024 or when 5,000 Entries are received; whichever occurs first (the “Contest Period”). This Contest is sponsored by Ring, LLC d/b/a Ring (“Ring” or “Sponsor”).

2. Eligibility/Participation: The Contest is open to legal residents of the 50 United States, and the District of Columbia, who are eighteen (18) years of age or older, and the age of majority in their jurisdiction of residence as of the date of their participation, and as of September 23, 2024, own the Ring device or have shared user access (i.e. access to a Ring device shared with an individual by a Ring device owner) to the Ring device associated with an Entry (as defined below). If you are a shared user on a Ring device on which the video that is submitted was captured, you must have all necessary rights to enter the Contest from the owner of the Ring device and understand and agree that we may confirm your submission and such rights with the Ring device owner, including disclosure of your name to the Ring device owner.  Employees of Ring, Don Jagoda Associates (“Administrator”), competitors of Ring and its and their affiliates, subsidiaries, franchisees, agents, advertising and Contest agencies and fulfillment companies, and their immediate families (parents, children, siblings, spouse) and members of their same households are not eligible to participate in the Contest. By participating in the Contest, you agree that: (1) you have read and understand these official rules (“Official Rules”); (2) you meet the Contest eligibility requirements as explained in the Official Rules; (3) you accept and agree to be bound by these Official Rules, to Ring’s Terms of Use and Privacy Notice as published at https://ring.com/terms and https://ring.com/privacy-notice and (4) you unconditionally accept and agree to comply with and abide by the decisions of Ring and Administrator, whose decisions shall be final and binding in all respects.

3. How to Enter: As a condition of entering the Contest, entrants may be required to provide certain identifying information and contact information, as well as details regarding entrant’s Entry (defined below). Noncompliance with this requirement will prevent entry into the Contest. There is one (1) way to enter the Contest.  During the Contest Period, an entrant may enter by visiting https://ring.com/ghostsearch, (the “Website”) to upload and submit a video, recorded with a ring device, capturing the presence of ghost(s), ghostly presence, or depicting ghosts in an unrealistic manner using artificial aids, such as costumes to be eligible to win the grand prize (“Grand Prize”) described below. Entry must include a maximum 100-word story explaining the depiction in the video (video and story collectively defined as “Entry”). Entrants may use artificial aids, such as costumes or accessories, manmade vehicles, makeup, props, and/or other artificial means to capture the “ghost”. An Entry may include comedic depictions of “ghosts”.  Entrant must be able to log into their Ring account to upload a video or have shared user access to the Ring device associated with an Entry. Each entry must be unique.

All Entries must be submitted with a completed official Contest entry form (“Contest Entry Form”) on https://ring.com/ghostsearch through a button accessible on the Contest landing page. All Entries must be received on or before 11:59 PM PT on November 1, 2024 or before 5,000 Entries are received; whichever occurs first. The computer clock of Ring is the official time-keeping device in the Contest. All Entries become the property of Ring and will not be returned.

All Entries must be the entrant’s original work and cannot have previously been entered into a contest/promotion of any kind and/or won an award (or previously provided any rights to the video to any other party) but can be recorded on dates prior to Contest start date.

Entry may not contain, as determined by Sponsor, in its sole discretion:

  • Content that infringes or violates any third party’s intellectual property, property, or privacy rights, which includes a third party’s phrases, trademarked material, music, art, works of authorship, or other third-party materials.
  • Content that promotes any illegal activity; promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message; is obscene or offensive; endorses any form of hate or hate group;
  • Personal identification, such as license plate numbers, full names, e-mail addresses  or other identifying information of any person or entity other than you.
  • Material that is inappropriate, indecent, sexually explicit or suggestive; unnecessarily violent, profane, obscene, hateful, tortuous, derogatory of any ethnic, racial, gender, religious, professional or age group, (including using words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group).
  • Content which violates any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, and false advertising).
  • Content that promotes violence or engages in, encourages, advocates, discusses with the intent to commit, or provides instructions for conduct that would constitute a criminal or civil offense or would otherwise violate any federal, state, local or international law or rule.
  • Material or content that is, or may reasonably be considered to be, hate speech, whether directed at an individual or group, and whether based upon the race, sex, creed, national origin, religious affiliation, marital status, sexual orientation, gender identity, or language of such individual or group or that is otherwise unlawfully threatening or unlawfully harassing to any individual, partnership, corporation, or political body.
  • Content that disparages, slanders, or libels persons or organizations associated with Sponsor or any other brand, company or individual.

Any Contest Entry deemed inappropriate or unsuitable, in Sponsor’s sole discretion, will be disqualified.  Entries must be suitable for presentation in a public forum, in the sole discretion of the Sponsor. Entrants and all submitted Entries must be in keeping with Sponsor’s image and the theme of the Contest, as determined by Sponsor, in its sole discretion.

In the event of a dispute as to any Entry, the individual who submitted the Entry will be deemed to be the entrant. Potential winner may be required to show proof of being the individual who submitted the Entry. In the event two or more entrants submit identical Entries, the individual entrant(s) who submitted a later Entry or Entries (i.e. an Entry with a later timestamp) will not be eligible for the Grand Prize.

DANGEROUS, RISKY OR HAZARDOUS ACTIVITY SHOULD NOT BE UNDERTAKEN IN CONNECTION WITH THIS CONTEST. NO LIVING CREATURE OR ORGANISM/PERSON OR ANIMAL SHOULD BE HARMED IN ANY WAY IN THE FULFILLMENT OF THIS CONTEST. ANY SUCH CONDUCT WILL RESULT IN DISQUALIFICATION.

4. Judging/Verification/Winner Notification:  Only the first 5,000 Entries will be judged and only the first 30 seconds of each Entry video will be considered. All Entries will be judged by Administrator-selected judges (“Judges”) (which may include, but is not limited to, Administrator, Sponsor, Finn Wolfhard and Katrina Weidman) who will be judging all throughout the Contest Period and by November 11, 2024.  Each Entry will be awarded points (100 points max) based on the following judging criteria:

  • Visibility/Clarity of the “Ghost” (1-25 points): Was the “ghost” or ghostly presence clearly evident in the video?
  • Uniqueness of Entry (1-25 points): How much did the footage/story surprise the judges?
  • Entertainment Value (1-25 points): How glued to the footage were our judges and was the footage/story amusing?
  • Engagement (1-25 points): Was the “ghost’s” engagement with the Ring device unique?

The judging criteria outlined above will be collectively known as the “Judging Criteria.” The Judges will use the Judging Criteria to determine the Grand Prize entrant (“Grand Prize Entrant”). Any tied Submissions will be re-judged by the judges based 100% on Entertainment Value. Katrina Weidman and Finn Wolfhard will judge the top entries, and the entrant who is awarded the most overall points and confirmed will be deemed the Grand Prize winner (“Grand Prize Winner” or “winner”). By participating, entrants agree to these Official Rules and the decisions of the Judges. All decisions made by Ring and Administrator on all matters relating to this Contest are binding, final and are not open to appeal. By entering the Contest, entrants agree to abide by the Judges’, Administrator’, and Ring’s decisions and waive any right to appeal. The potential Grand Prize Entrant will be notified by email and will be required to sign and return via DocuSign and Amazon’s Tax Central portal, a Declaration of Eligibility, liability/publicity release (except where prohibited by law), assignment of rights (“Declaration”), and tax documentation (W9) within five (5) days of notification attempt or the Grand Prize Entrant may be disqualified and an alternate Grand Prize Entrant may be determined from the next highest scoring Entry (as outlined above). Return of Declaration as undeliverable, if Grand Prize Entrant is deemed ineligible, or if Grand Prize Entrant is not reachable by using the information provided on the official Contest Entry Form, Grand Prize Entrant will be disqualified and an alternate Grand Prize Entrant will be determined (as outlined above) to receive the Grand Prize.

Grand Prize Entrant understands and agrees that, as a condition of becoming the confirmed Grand Prize Winner, they may be subject to a background check at the sole discretion of Sponsor; failure to comply may result in disqualification and forfeiture of Grand Prize. In addition, at the discretion of the Sponsor, Grand Prize Entrant may be disqualified: (a) if charged with or convicted of a felony or misdemeanor; (b) if Sponsor determines, in its sole discretion, that awarding the prize to such individual may reflect unfavorably on the Contest or Sponsor; (c) if they are not eligible to receive the prize based on the eligibility requirements set forth in these Official Rules; (d) if Sponsor determines that they have failed to comply with these Official Rules in any way; or (e) if they refuse to or cannot accept the prize for any reason. Each Grand Prize Entrant’s social media profile must be in keeping with the Sponsor’s image or they may be disqualified, in Sponsor’s sole discretion.

5. Grand Prize: The Grand Prize Winner will receive One Hundred Thousand Dollars ($100,000), to be awarded as a check. All federal, state, local, and other taxes on the Grand Prize, and any other costs and expenses associated with prize acceptance and use not specified herein are solely the responsibility of the winner.

6. General Terms/Limitation of Liability/Releases: In the event there is a discrepancy or inconsistency between disclosures and other statements contained in any Contest materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern, and control. Ring and its agencies and affiliates are not responsible for any error, omission, interruption, deletion, defect, delay in operations, theft, destruction, unauthorized access to, or alterations of, Entry materials, or failure to receive any Entry information. Further, Ring and its agencies and affiliates are not responsible for late, lost, damaged, destroyed, delayed, or incomplete entries. Additionally, Ring and its agencies and affiliates are not responsible for any problems or technical malfunction(s) of any telephone network or lines, computer online systems, servers or other services, providers, computer equipment, software, failure of any e-mail, technical problems or traffic congestion on the Internet or at any website, including, without limitation, any injury or damage to entrant’s or any other person’s computer related to or resulting from participation in this Contest. Ring reserves the right, in its sole discretion, to suspend, modify or cancel the Contest and only determine the winner if there are any eligible Entries received that meet the criteria listed above. By participating, entrants agree to be bound by these Official Rules and the decisions of the Judges. Entrants agree that Ring, Administrator and their respective directors, officers, employees, subsidiaries, affiliates, divisions, agencies, licensors and all prize suppliers (“Released Parties”), (a) shall not be responsible or liable for, and hereby release and hold harmless the Released Parties from, any claims, losses, damages or injuries of any kind (including death) resulting, in whole or in part, directly or indirectly, from participation in the Contest or any Contest-related activity, or from acceptance, receipt, possession and/or use/misuse or inability to use prize, and (b) have not made any warranty, representation or guarantee, express or implied, in fact or in law, with respect to the prize. The Released Parties shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience or irregularity that may be caused or contributed to (1) by any wrongful, negligent or unauthorized act or omission on the part of any of their agents, servants, employees or independent contractors; (2) by any wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of the Released Parties; or (3) by any other cause, condition or event whatsoever beyond the control of the Released Parties. Failure of Ring to enforce any provision herein shall not be deemed a waiver of such. WITHOUT LIMITING ANYTHING SET OUT ELSEWHERE IN THESE OFFICIAL RULES, UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANTS HEREBY WAIVE ALL RIGHTS TO CLAIM, DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR ANY OTHER DAMAGES WHATSOEVER, AND ATTORNEYS’ FEES. IN NO EVENT SHALL RING OR ITS SUBSIDIARIES, AFFILIATES, ADVERTISING AND CONTEST AGENCIES, PARTNERS, REPRESENTATIVES, AGENTS, SUCCESSORS, ASSIGNS, EMPLOYEES, OFFICERS AND DIRECTORS BE LIABLE TO ANY ENTRANT OR WINNER FOR DAMAGES THAT EXCEED THE VALUE OF THE PRIZE TO BE AWARDED IN THIS CONTEST. In the event that a court, or other tribunal of competent jurisdiction, shall hold any of the provisions of these Official Rules to be illegal, invalid, or unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Official Rules shall otherwise remain in full force and effect. Except where prohibited by applicable law, participation in the Contest constitutes an individual’s consent to Ring’s, its parents’, subsidiaries’, affiliates’, licensees’, successors’, assigns’, talents’ and influencer partners’ use of such individual’s name, likeness, photograph, voice, and opinions for advertising and other purposes in any and all media, now or hereafter devised, in any manner, worldwide in perpetuity, without further payment or consideration, notification or permission. This Contest is subject to these Official Rules. Failure to comply with The Official Rules will result in disqualification. An entrant’s Entry will be disqualified, at the sole discretion of Ring, if he or she attempts (a) to enter the Contest through any means other than described in these Official Rules; or (b) to disrupt the Contest, circumvent the terms and conditions of these Official Rules, or in any way tamper with any component of the Contest. All rights (including copyright) in the Entries submitted will become the property of Ring and its assignees, and upon Ring’s request, entrants will execute any documents necessary to effectuate such ownership.

7. Governing Law/Venue: THE CONTEST IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF CALIFORNIA, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN HAWTHORNE, CALIFORNIA, WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS WHICH MIGHT OTHERWISE CAUSE THE APPLICATION OF THE LAWS OF ANY JURISDICTION OTHER THAN THE STATE OF CALIFORNIA. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN CALIFORNIA. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF LOS ANGELES. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. PARTICIPANTS AGREE THAT ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS CONTEST SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.

8. Request for Winner List:  For the name of the winner, available after December 1, 2024, send an email to winners@dja.com with “Ring’s Great Ghost Search Contest Winner and 01-2945-02” as the subject line.  Winner List will be sent after the Grand Prize has been awarded.
